City Council Minutes

                            December 1st, 2014 

The City Council of the City of New Munich met in regular session at 6:30 p.m., in the City Hall. Harold Klaphake, Shawn Duevel, Pat Nathe, Dan Krueger and Charles Borgerding were present.

On a motion by Charles Borgerding, seconded by Shawn Duevel and carried the minutes from November 3rd, 2014 were approved.

Fire Chief, Allen Fiedler was present and informed the Council of two rescue calls last month. He also submitted a few bills that needed to be paid.

Cindy Pundsack was present and informed the Council that their neighbors’ dogs bark all the time. The Council informed Cindy to call Stearns County Sheriff Department cause they are the ones who inforce our ordinances. Mayor, Harold will also call Stearns County.

Water/Wastewater operator, Brian Mehr was present and informed the Council that he is working with MPCA for renewal of the City’s Permit. He asked the Council if there could be a shelf installed in the pump house to get items off the floor. He also thanked the Council for cleaning the pump house. Brian is still working on the chlorine level. He also asked the Council for their feedback.

On a motion by Harold Klaphake, seconded by Charles Borgerding carried and approved $10,000 will be transferred from the Fire fund to the Fire truck fund.

On a motion by Harold Klaphake, seconded by Pat Nathe carried and approved a public hearing is scheduled for January 5th at 6:30pm to amend  Ordinance No. 64 Licensing and regulating the sale and consumption of intoxicating liquor, 3.2 percent malt liquor, and wine.

Pat Nathe informed the council that the vent in the maintenance shed needs to be vented. Pat will take care of the situation.

On a motion by Charles Borgerding, seconded by Dan Krueger, carried and approved the City generator will be brought to Melrose Implement for repairs.

                            November 3rd, 2014


The City Council of the City of New Munich met in regular session at 6:30 p.m., in the City Hall. Harold Klaphake, Shawn Duevel, Pat Nathe, Dan Krueger and Charles Borgerding were present.

On a motion by Charles Borgerding, seconded by Shawn Duevel and carried the minutes from October 6th, 2014 were approved.

Fire Chief, Allen Fiedler was present and informed the Council of no calls last month. Allen also informed the Council of one new member to the department, Josh Blonigan.
Mayor Harold informed Allen to flush the dead end lines once a month. Allen submitted a few bills that need to be paid. The fire department is looking at amending their ordinance. They want to change the hiring process by doing background checks with applications. The fire department will check out other departments and was tabled till the next regular scheduled meeting. Allen also asked if they could do the general maintenance on the truck and at what locations.

Water/Wastewater operator, Brian Mehr was present and informed the Council that he has been communicating with MPCA and MDH to see where we are at. City Clerk, Kelly Thielen will do the electronic submittal to MPCA. Brian is also having an issue with one of the down gradient wells to pull a sample. He will continue to work on it. He has purchased a new pH meter because the original would not calibrate correctly, cost around $350.00. Brian went over some items he noticed that needs changes to the draft of SDS permit (discharge permit). This renewal processes is every five years.
1. The facility description has two lift station listed but there are three.
2. The ribs are listed as .5 acres and the as-builds show them as .55 acres.
3. The draft permit shows the south pond at 3.3 acres but also describes it as 3.4 acres.
Brian will continue with the renewal process. Xcel came in and did some maintenance which caused the pumps to run backwards. This issue has been corrected. MDH has not received any monthly fluoridation reports from February-September. Brian was unable to find those documents. Mayor, Harold will contact Preferred Controls to check out why the water tower is over flowing at times. He will also get someone to check out the down spout on the tower. Brian also informed the Council that the well house needs to be cleaned.

On a motion by, Harold Klaphake, seconded by Dan Krueger and carried the following building permits were approved, Justin Boecker, Elmer Boecker and Shady’s Bar and Grill (emergency permit). On a motion by Charles Borgerding, seconded by Dan Krueger and carried the following building permit was denied, Tom and Sasha Newman to move in a cargo box.

Laura Hoppe was present and inquired about her utility bill, she pays $122.00 quarterly and she thinks that is too much for a single person and she also has her own well. The Council explained that when they expanded the lagoon they took the average of all sewer usage and that is the amount they came up with for residents who have their own well.

Fire Relief Treasure, Karen Timp was present to ask for approval to increase the benefit from $500.00 to $550.00. On a motion by Harold Klaphake, seconded by Charles Borgerding and carried the increase was approved. The new benefit will take effect January 1, 2015.

Zoning Ordinance is tabled till next regular scheduled meeting.

On a motion by Charles Borgerding, seconded by Pat Nathe and carried Jim Rieland was hired as Groundskeeper. Jim will be paid $10.00 per hour.

On a motion by Harold Klaphake, seconded by Charles Borgerding and carried Thomas Valerius was hired as Water/Wastewater Operator. He will work under Brian Mehr for a year and then he will be on his own. Tom will be paid $10.00 per hour.

On a motion by Harold Klaphake, seconded by Pat Nathe and carried Brian Mehr will be paid $600.00 monthly.

On a motion by Charles Borgerding, seconded by Dan Krueger and carried to purchase a manhole cover lifter for $206.08 was approved.

On a motion by Pat Nathe, seconded by Dan Krueger and carried the Service Master bill of 504.43 from Tom and Sasha Newman were approved.

                              October 6th, 2014 

The City Council of the City of New Munich met in regular session at 6:30 p.m., in the City Hall. Harold Klaphake, Shawn Duevel, Pat Nathe, and Charles Borgerding were present, Dan Krueger was absent.

On a motion by Pat Nathe, seconded by Charles Borgerding and carried the minutes from September 2nd, 2014 were approved.

Fire Chief, Allen Fiedler was present and informed the Council of no calls last month. Allen also submitted a few bills that need to be paid.

Jaycee member, Sandy Zierden was present for approval on Resolution 10-14-A, a one day off site gambling permit. On a motion by Harold Klaphake, seconded by Shawn Duevel and carried Resolution 10-14-A was approved.

On a motion by Charles Borgerding, seconded by Pat Nathe, carried and approved the City of New Munich will pay 1/3 of the cost of lights that were installed in the City Park. The New Munich Lions and the New Munich Jaycees will each pay 1/3.

Water/Wastewater Operator, Mike Sand was present and informed the Council that everything seems to be running okay. Mike submitted two postage bills which need to be paid.

Mayor Harold informed Mike that we as the Council have discussed the stipulation agreement, fines past and future from MPCA and your future employment with the City,
The reason you should be terminated from your water/wastewater and groundskeeper positons with the City are as follows, recommendation from the City Attorney, MPCA violations, false documentation, not meeting agreed deadlines, and additional late DMR for August, 2014 which added additional penalty of $900.00. Mayor, Harold asked Mike if he had any questions and Mike informed the Council that not having a computer and internet and what he was trained with he was doing the best he could do. On a motion by Shawn Duevel, seconded by Pat Nathe, carried and approved, as of October 6th, 2014 Mike Sand was terminated from his water/wastewater and groundskeeper positons. Harold asked Mike to return all city property to him immediately; which includes keys, paperwork, tools, equipment and etc.

Tom and Sasha Newman were present and discussed a Service Master bill which the City of New Munich’s insurance will not cover because someone propped open the man hole on 7th ave which cause back up water to flow in there basement. They do have a check valve.
They will send the final amount for approval at the next regular scheduled meeting.

Tom Newman also asked the Council if he could get a catch of some type to stop all the stuff which flows into their pond. The Council informed Tom that the pond is a manmade pond, private property and the road is the State Highway.

On a motion by Pat Nathe, seconded by Charles Borgerding and carried the following building permits were approved, Tim Klaphake and New Munich Baseball Team.

Zoning ordinance tabled till the next regular scheduled meeting,

On a motion by Pat Nathe, seconded by Shawn Duevel, carried and approved Brian Mehr will help out the City until someone is fully trained as water/wastewater operator.

Mayor, Harold Klaphake will check the lift stations daily and record meters.

On a motion by Pat Nathe, seconded by Shawn Duevel, carried and approved, help wanted Ads will go into the Melrose Beacon with a deadline of October 29th to submit resumes to the City of New Munich.

On a motion by Harold Klaphake, seconded by Charles Borgerding, and carried the Liability coverage waiver form was approved.

The Council had a few questions about the list of property, vehicle schedule, liability rating survey and liability rating expenditures survey. Kelly the City Clerk will email Jim from Greenwald insurance to get more information.

On a motion by Charles Borgerding, seconded by Pat Nathe and carried to replace the window in the well house was approved.

                               September 2nd, 2014

The City Council of the City of New Munich met in regular session at 6:30 p.m., in the City Hall. Harold Klaphake, Shawn Duevel, Pat Nathe, Dan Krueger and Charles Borgerding were present.

Dan Krueger was sworn in as Council Member to replace Neil Austin and finish out his term.

On a motion by Shawn Duevel, seconded by Charles Borgerding and carried the minutes from August 4th and 19th, 2014 were approved.

Fire Chief, Allen Fiedler was present and informed the Council of two rescue call last month. Three fire fighters will be taking Fire Fighter One Training. $1,940.00 will be paid by Minnesota Board Fire Training Education (MBFTE).

Waste/water operator, Mike Sand was present and informed the Council that both wells were acid treated. Mayor, Harold informed Mike that he needs to clean the Well house. On a motion by Pat Nathe, seconded by Dan Krueger, carried and approved, Worms Lumber will remove and close the window in the well house.

On a motion by Harold Klaphake, seconded by Charles Borgerding and carried a one day on sale liquor license was approved for the New Munich Firemen’s Supper on Saturday, October 11th.

Mike informed the Council that he will have all the incomplete information for MPCA done in 15 day.

On a motion by Charles Borgerding, seconded by Shawn Duevel and carried the Stipulation Agreement and penalty for MPCA was signed and will be mailed the next day.

On a motion by Shawn Duevel, seconded by Pat Nathe and carried the agreement for Property Assessment Service between the County of Stearns and New Munich City was approved.

On a motion by Charles Borgerding, seconded by Dan Krueger and carried Resolution
9-14-A was approved.

Kris Schiffler, owner of Shady’s Bar and Grill was present to ask for a one day outdoor Liquor License for Saturday, Sept 13th. They will have the area fenced off and the event will go till about midnight. On a motion by Shawn Duevel, seconded by Pat Nathe and carried the one day out door Liquor License was approved.

Jim Poepping was present and informed the Council that the Stop sign by Westerns Street and County Road 30 needs to be replaced. Mayor Harold will contact the County.

                               August 19th, 2014 

The City Council of the City of New Munich met in session at 6:30 p.m., in the City Hall. Harold Klaphake, Pat Nathe, Shawn Duevel and Charles Borgerding were present, Dan Krueger was absent.

Mayor, Harold had two bids for new lift stations, one from Dakota Pumps and the other from Nelson Electric. Dakota Pumps bid was $29,251.48 (5 horse power) for the South lift station and $32,584.92 (5 horse power) for the North lift station. Mayor, Harold called local cities that went with Dakota Pumps like Sartell, St James and Belgrade and they all gave good reports. The bid from Nelson Electric was $27,708.00 (5 horse power) South lift station and $27,708.00 (7 ½ horse power) north lift station. He called Zimmerman, Buffalo and Osakis and also gave good reports. Pat Nathe also talked to Osakis and he commented that they respond quickly when needed.

On a motion by Harold Klaphake, seconded by Pat Nathe and carried the bid from Nelson Electric was approved.

On a motion by Pat Nathe, seconded by Charles Borgerding and carried the meeting was adjourned at 7:40pm

August 2014 City Council Minutes

                               August 4th, 2014 

The City Council of the City of New Munich met in regular session at 6:30 p.m., in the City Hall. Harold Klaphake, Shawn Duevel, Pat Nathe and Charles Borgerding were present, Neil Austin was absent.

On a motion Charles Borgerding, seconded by Shawn Duevel and carried the minutes from July 7th, and 21st, 2014 were approved.

Fire Chief, Allen Fiedler was present and informed the Council of no rescue call last month. Louis Thompson retired from the fire department.

Waste/water operator, Mike Sand was present and informed the Council that he needed to change a probe on the North lift station and replaced a check value on the South lift station last month.

Jesse Job, owner of 651Main Street plans on digging a new water line to the main because of lower water pressure. He will submit a $500.00 bond check to the City.

On a motion by Pat Nathe, seconded by Charles Borgerding and carried the following building permits were approved. Gerald Holdvogt, Harold Klaphake, Nicole LeClaire and Ray and Flori Mayers. On a motion by Harold Klaphake, seconded by Charles Borgerding and carried Pat Nathe will renew his building permit(#700) for one more year was approved.

On a motion by Pat Nathe, seconded by Charles Borgerding and carried a second Council meeting on August 19th, at 6:30pm was approved.

The City had two bids for new lift stations, from Dakota pumps and Nelson Repair.
The City would like more information from both companies before making a decision.
This is tabled till our next scheduled meeting on Tuesday, August 19th at 6:30pm.

On a motion by Harold Klaphake, seconded by Charles Borgerding and carried a counter offer of $10,000 over a three year period to MPCA was approved.

On a motion by Harold Klaphake, seconded by Charles Borgerding and carried Dan Krueger was appointed to finish a two year term as Council member was approved.

Clean up time, August 20th at the Immaculate Conception Church Parking lot from 1pm-3pm. We are looking for some volunteers; Mayor Harold said he would help out. Anyone else interested please contact Kelly, City Clerk 837-5274.

City Council Minutes

July 7th, 2014

The City Council of the City of New Munich met in regular session at 6:30 p.m., in the City Hall. Harold Klaphake, Shawn Duevel, Pat Nathe and Charles Borgerding were present, Neil Austin was absent.

On a motion Charles Borgerding, seconded by Pat Nathe and carried the minutes from June 2nd, 2014 were approved.

Fire Chief, Allen Fiedler was present and informed the Council of one rescue call last month. The New Munich Fire Department has two pumper trucks now so they can be called out on mutual aid calls.

On a motion by Pat Nathe, seconded by Charles Borgerding and carried the following building permits were approved, Steve and Jackie Moll and Ashley Altendahl.

On a motion by Pat Nathe, seconded by Charles Borgerding, carried and approved a Public Hearing for a Variance for Tree of Assist Living and a Special Council meeting follows on Monday, July 21st, 6:30pm at the Immaculate Conception Church Basement.

On a motion by Pat Nathe, seconded by Shawn Duevel and carried the Renewal application for optional liquor 2am license for Munich Hofbrau was approved.

Jen Brickweg was present and asked the Council if they can level the lot next to her. It is quite a bit lower. Mayor Harold will ask Roger Boecker to add more fill.

Jaycee Member, Ann Waterbury was present to get approval for a one-day on sale liquor license for the New Munich Jaycees. On a motion by Harold Klaphake, seconded by Charles Borgerding and carried the one-day on sale liquor license was approved for August 22nd (Johnny Holm).

On a motion by Pat Nathe, seconded by Shawn Duevel and carried the Renewal application for optional liquor 2am license for Shady’s Bar was approved.

Waste/Water Operator, Mike Sand was present and informed the Council that he needed to pull the two pumps on the South Lift station. The pressure switch for the water tower is defective and Mike is waiting for a new one to replace the defective one. Frank Stankey from Rural Water will be coming on July 15th to train Mike on the Lagoon and paperwork. Mike informed the Council that he has everything done except for sending the late DMR supplementals to the MPCA.

On a motion by Charles Borgerding, seconded by Shawn Duevel and carried the bid to acid treat the wells for $2520.00 from Wheels Wells was approved.

The Council would like the City Clerk to send Mike and Ann Waterbury a notice to remove the two dead trees on their property. The dead branches are hanging over the street.
